This Refund & Cancellation Policy ("Policy") sets forth the terms and conditions governing purchases, subscriptions, refunds, chargebacks, and account cancellations on the DistroVibe digital music distribution platform.
By registering an account or purchasing a subscription plan, you ("User", "Artist", "Label", or "Licensor") agree to this Policy in its entirety. If you do not agree, please do not use our services.
1. The Nature of Digital Distribution and SaaS
DistroVibe operates as a Software-as-a-Service (SaaS) and digital distribution provider. Because our services involve the transmission of digital audio files and metadata to third-party Digital Service Providers (DSPs), there is no physical mechanism to "return" the service once it has been rendered.
Standard consumer return policies applicable to physical goods do not apply to DistroVibe's services. Your eligibility for a refund depends on the progression of your release.
2. The 30-Day Conditional Money-Back Guarantee
DistroVibe offers a conditional 30-day money-back guarantee for the initial purchase of an annual subscription plan.
Forfeiture Trigger
Your right to claim a refund is forfeited once the "Execution of the Contract" has begun.
Execution is defined as:
- Uploading a release to the dashboard.
- QA review and approval of content.
- Delivery to or ingestion by any DSP.
- Content going live on any digital store.
3. Exclusions: Violations That Void All Refunds
DistroVibe maintains zero tolerance for platform abuse. Your right to a refund is void under:
Copyright Infringement
Flagged, rejected, or taken down due to unauthorized material, uncleared samples, or stolen beats.
Artificial Streaming
Engagement in bot networks, click farms, or systematically manipulated streaming activity.
DSP Fines & Penalties
If your tracks are fined by Spotify (€10 penalty) or any other DSP for fraud.
Metadata Abuse
Rejected for keyword stuffing, generic content, or misleading artist naming ("Sleep Music", etc.).
Artist Impersonation
Unauthorized deepfakes, AI voice clones, or identity theft of established artists.
4. Cancellation of Service and Takedowns
4.1. Effect of Cancellation
Upon canceling your active subscription, music is not immediately removed unless you issue a "Takedown Request." Takedowns can take 30 to 60 days for global DSPs to process fully.
4.2. Unpaid Balances and Royalties
Canceling your account does not entitle you to a prorated refund. Negative balances due to DSP fines are not absolved by cancellation; DistroVibe reserves the right to charge your payment method or withhold royalties to settle debts.
5. Chargebacks and Payment Disputes
Fraudulent Chargeback Consequences
Filing a chargeback for services rendered is a serious violation. If you initiate a dispute:
- Account is locked and closed immediately.
- Global takedown issued for your entire music catalog.
- All accrued and unpaid royalties are frozen and seized to cover penalty fees.
- You are permanently banned from using DistroVibe services.
6. DSP Ingestion Delays and Third-Party Errors
DistroVibe is an intermediary pipeline. Once content is delivered to Spotify, Apple, or TikTok, the time to go live is out of our control. We do not offer refunds or credits when:
- A DSP takes longer than expected to ingest.
- A DSP places music on the wrong artist profile.
- A DSP experiences technical glitches or downtime.
- A DSP independently rejects music due to internal quality standards.
7. Renewals and Add-on Services
7.1. Subscription Auto-Renewal
All subscriptions auto-renew. It is your responsibility to cancel before the renewal date. We do not issue refunds for forgotten renewals.
7.2. Add-On Services
Fees for specialized services (YouTube OAC setup, physical distribution, custom mastering) are non-refundable once initiated.
8. Modifications to This Policy
DistroVibe reserves the right to update or change this Policy at any time. Continued use of the platform constitutes acceptance of the revised Policy.
